Conservative Thinking at its Best

03/30/05
"When the fervor of political passions moves the executive and legislative branches to act in ways inimical to basic constitutional principles, it is the duty of the judiciary to intervene. If sacrifices to the independence of the judiciary are permitted today, precedent is established for the constitutional transgressions of tomorrow."

Stanley F. Birch Jr.
Judge, United States Court of Appeals, 11th Circuit

This is fundamental to the defence of your written constitution, indeed to the defence of Freedom in the US. In the UK our constitution is unwritten but all new legislation is tested by the Judiciary and then supported (eventually) by case law. Slow but effective. Still here, still a democracy, despite what you may read!
